4. Filing a DMCA Takedown Notice

If you believe that content available on our Website infringes your copyright, you may submit a written notification to our designated agent. To be effective, the notification must be in writing and include the following information:

5. How We Process DMCA Notices

Upon receipt of a valid DMCA takedown notice, we will:

  1. Review the notice to ensure it contains all required elements.
  2. Remove or disable access to the allegedly infringing material within 5 business days.
  3. Notify the user who posted the content that we have removed or disabled access to their content.
  4. Keep a record of the complaint and our response.

Please note that we may not be able to act on incomplete or defective notices. If your notice is missing required information, we may request additional details before taking action.

6. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:

  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Upon receipt of a valid counter-notification, we will:

  1. Promptly provide the person who submitted the original takedown notice with a copy of the counter-notification.
  2. Inform that person that we will replace the removed material or cease disabling access to it in 10 business days.
  3. Replace the removed material or restore access to it 10 to 14 business days after receiving the counter-notification, unless our designated agent first receives notice from the person who submitted the original notification that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity.

7. Repeat Infringer Policy

The Detail Woman, LLC has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.

A “repeat infringer” is a user who has been the subject of more than one valid DMCA takedown notice. We may terminate or suspend access for users who we believe, in our sole discretion, are repeat infringers.

We reserve the right to terminate user accounts after two confirmed instances of copyright infringement, though we may do so after a single instance in cases of particularly egregious infringement.

8. Misrepresentations

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. This includes damages, including costs and attorney’s fees.
